Ram Air Sky Sport is a brand of JIP AVIACIO SLU with physical retail store located in Sector Aeroclub sn (street) in 17487 Empuriabrava, Spain, and operates the Internet shop in www.360SkyPro.com owned by JIP Aviacio SLU with European tax number B17449836 (hereinafter "Ram Air Sky Sport" or "360 Sky Pro"). Ram Air Sky Sport is dedicated to the sale of sport equipment (hereinafter "products" or "goods") on the Internet and in the physical store. Section 4: Delivery 4.1. Overview: Orders that are ordered from www.360SkyPro.com ship to: Spain (except Ceuta and Melilla), England, France, Finland, Ireland, Sweden, Austria, Belgium, Czech Republic, Denmark, Germany, Luxembourg, Holland, Italy, Slovakia, Slovenia, Greece, Portugal (except islands), Kuwait, Qatar, Oman, Bahrain and Dubai. The products are being sent to the during the order process specified address. If the size of the order or the size of the products make it necessary, several packets may be sent. Possible deficiencies include defects in materials and production failures. In case of a warranty claim, the defective item will be repaired, replaced or credited for free. Defects caused by normal product wear and tear, misuse, personal negligence and external influences by humans, animals or force majeure are not contemplated in the warranty claim. This warranty applies at EU-wide level, including Switzerland, and is binding on all consumer goods. The legal warranty does not include defects caused by normal product wear and tear, misuse, personal negligence and external influences by humans, animals or force majeure. Made to measure suits and custom made products: All custom and made to measure products are guaranteed to be free from defects in workmanship and material. We consider a use of up to 250 jumps per year or a maximum of 4 hours of wind tunnel use per year to be "normal use". Heavier than "normal use" use is excluded from the warranty. Subsequent corrections in size or material are not included in the purchase price. We reserve the right to charge the customer for any adjustments and/or material changes requested after the end of production of the custom ordered item. Custom suits and helmets are made to measure and produced in individual design. These items are manufactures especially respecting the taste and choices of the individual customer and can therefore neither be changed nor returned.
Section 6: Statutory defect liability law
In the case of contracts with consumers, the statutory liability for defects applies. JIP Aviacio SLU assumes no responsibility for the options selected by the user, such as selection of the order quantity or the product type. Deviations of the ordered or delivered goods from the order, in particular with regard to material and colour, remain reserved for technical reasons. An additional guarantee exists only if it was expressly issued in the order confirmation regarding the respective product. Claims of the customer for damages are excluded. This excludes claims for damages of the customer arising from injury to life, body, health or the contravention of essential contractual obligations as well as liability for other damages which are based on a deliberate or grossly negligent breach of duty by JIP Aviacio SLU, their legal representatives or vicarious agents. Essential contractual obligations are those whose fulfilment is necessary to achieve the objective of the contract. In the event of the contravention of essential contractual obligations, JIP Aviacio SLU shall only be liable for typically foreseeable damage if it was simply caused negligently, unless it concerns claims for damages of the customer arising from injury to life, body or health. The restrictions shall also apply in favour of the legal representatives and vicarious agents of the provider if claims are asserted directly against them. For orders from the customer who is an entrepreneur pursuant to Section 14 of the Civil Code, the warranty shall be limited to twelve (12) months. For contracts with consumers pursuant to Section 13 of the Civil Code, the warranty shall be two (2) years from receipt of the goods. The provisions of the Product Liability Act shall remain unaffected.
